These Terms and Conditions of Use of the Nutritious Yoana Website (hereinafter referred to as the “Terms and Conditions”) contain detailed information about your rights and obligations while using the Website and purchasing products via the online shop. By using our Website, you agree to these Terms and Conditions and acknowledge that you have read and understood them. Do not continue to use the Nutritious Yoana Website and products if you do not agree to all of the Terms and Conditions set forth on this page.

Chapter 2 – Nutritious Yoana Hub Content

On our Website, you can access and purchase a variety of digital resources and content, including cookbooks, meal plans, recipe guides, videos, and other educational materials related to healthy cooking and lifestyle (hereinafter referred to collectively as the “Content”).

Each Content item includes a detailed description, such as the language, author or creator, number of pages or modules, format (PDF, video, etc.), included features, and any other relevant information. This information is available on the respective product page and during the checkout process.

All Content is delivered digitally through your user account on the Nutritious Yoana Website and is intended for personal, non-commercial use only. Access and use of the Hub’s Content are subject to the terms outlined in these Terms and Conditions.

Unless otherwise stated, we, Nutritious Yoana and/or our licensors, own the intellectual property rights for all content on the Nutritious Yoana Site, including the Cookbooks being sold. All intellectual property rights are reserved. The Cookbooks are published under a pseudonym used by the author.

You may access the Nutritious Yoana content for your personal use only, subject to the restrictions outlined in these Terms and Conditions.

The persons on the photos in the Cookbooks and on the Website are not the authors of the Cookbooks. The photos in the Cookbooks or parts of them may not have been taken by the authors of the Cookbooks. All photographs part of the Cookbooks and the Website are used lawfully, and their display in the Cookbooks does not infringe any rights of third parties.

You may not:

• Reproduce, distribute, modify, or create derivative works of our Cookbooks or Website content.

   

• Copy or republish material from the Nutritious Yoana Cookbooks and/or Website.

Chapter 4 – User Accounts and Access

To use our services, you must:

• Create an account with a valid email address.

   

• Subscribe to one of our paid monthly plans.
  

Each subscription grants you personal, non-transferable access to our content. Sharing of accounts is strictly prohibited. If we detect sharing or misuse, we may suspend or permanently terminate your account without refund.

Access is granted only as long as your subscription is active and fully paid. If payment fails or is canceled, your access to all content will be immediately suspended.

Chapter 5 – Subscription, Billing, and Cancellation

5.1 Subscription Prices

We offer access to our digital materials (including read-only PDFs, videos, recipes, meal plans and articles) through a paid monthly subscription (“Subscription”). Upon signing up, you gain access to all materials available on our platform as long as your Subscription is active and fully paid.

5.2 Introductory Offer

Occasionally, we may offer an introductory discount for a limited time (e.g., 7 days). These offers are available only once per user and apply only to new subscribers, unless otherwise stated. After the introductory period, the standard subscription price applies unless you cancel before the next billing cycle begins.

5.3 Automatic Renewal

Subscriptions renew automatically on a monthly basis using the payment method provided during checkout. Your Subscription will renew without explicit re-authorization unless you cancel before the end of your current billing period.

We reserve the right to update prices and will notify you in advance via email or through your account if changes affect your future billing cycle. Continued use of the services after a price change constitutes your acceptance of the new fees.

5.4 Billing and Payment

You agree to provide accurate and complete payment and billing information and to keep it up to date. All prices are inclusive of applicable taxes unless otherwise stated.

You authorize us to charge your subscription fees and any applicable taxes regularly to your chosen payment method. If a payment fails, we may attempt to process it again. Non-payment will result in immediate suspension or termination of access to the services.

5.5 Cancellation by You

You may cancel your Subscription at any time by logging into your account and navigating to the “Billing” or “Subscription” section. Cancellation takes effect at the end of your current billing period. You will retain access until the end of the paid period, but no further charges will occur.

5.6 No Pro-Rated Refunds for Partial Periods

Cancellation does not entitle you to a pro-rated refund for the remaining days of the billing period. You are responsible for all charges incurred before cancellation.

5.7 Suspension and Termination by Us

We reserve the right to suspend or terminate your Subscription and access to our services at any time, with or without notice, if:

• You violate these Terms and Conditions (including account sharing or misuse of content).

   

• Your payment fails or is reversed.

   

• Fraudulent or abusive behavior is detected.

   

In such cases, you are not entitled to a refund.

5.8 Limited Refunds

We offer a 30-day money-back satisfaction guarantee. If you are not satisfied with the services for any reason, you may request a full refund within the first 30 days of your last purchase.

Refunds are not available for transactions older than 30 days or more than 30 days prior to the date you contact us with a refund request.

Refunds may be granted in exceptional cases at the sole discretion of the company, 30 days after the last purchase. Refunds are not possible for accounts that have violated these Terms and Conditions.

Chapter 6 – Intellectual Property and Usage Restrictions

All content on the Website is the intellectual property of Nutritious Yoana and/or our licensors and is protected by copyright and other applicable laws.

You may not:

• Use parts of the content for commercial, public, or group training purposes.

   

• Use screen recordings, scraping, or similar technologies.

Access is granted solely for personal, non-commercial use. Any violation of this clause will result in immediate termination of the account without refund and may lead to legal action.

Chapter 7 – Complaints and Dispute Resolution

If you have issues with our service or product, please contact us via our contact form or email admin@nutritiousyoana.com to discuss the matter. We will make reasonable efforts to resolve the issue as quickly as possible and provide a written response to your complaint within 7 days. If additional information is required, this period may be extended depending on the circumstances.

If we fail to meet our contractual obligations, you have the right to file a complaint and/or seek compensation. If we cannot resolve your complaint, you have the right to pursue alternative dispute resolution such as mediation or arbitration, or seek legal remedies through a consumer protection organization or court.

You have the option to resolve consumer disputes through the “Alternative Dispute Resolution” procedure within the European Union. You also agree to waive any right to participate in class actions, class arbitrations, or other collective or representative proceedings.

Arbitration will be conducted in English under the rules of the International Chamber of Commerce (ICC) or a similarly recognized arbitration body.
The place of arbitration is Sofia, Bulgaria, unless otherwise legally required.
Each party bears its own legal costs and fees unless the arbitrator decides otherwise.
Exceptions: Either party may file a lawsuit in court to enforce intellectual property injunctive claims or to compel arbitration, as applicable.

Chapter 8 – User Conduct and Security

You agree to:

• Keep your login credentials confidential

   

• Use the services in good faith and only as intended

   

• Notify us immediately of any unauthorized access or security breach

   

We reserve the right to investigate suspected violations and to suspend or terminate accounts that violate these Terms.

Chapter 9 – Limitation of Liability

To the extent permitted by law:

• We are not liable for indirect, incidental, special, or consequential damages, including data loss, access interruptions, or lost profits.

   

• Our liability is limited to the total amount you paid in the 30 days preceding the claim.

   

• The services are provided “as is” without any express or implied warranty.

   

• We do not guarantee uninterrupted access to the Website or that the content will meet your specific expectations or learning outcomes.
